1. Terms & Conditions
Welcome to Emotional Intelligence Learning Pvt. Ltd. By accessing our services, programs, website, or materials, you (“User”, “Student”, “Client”) agree to the following Terms & Conditions.
1. Purpose of Services
We offer educational and skill developmental services including:
- Provide emotional intelligence - based learning and skill development
- Support emotional balance, self - awareness, and clarity
- Improve communication, relationships, and decision-making skills
- Offer education-focused guidance, not medical or psychological treatment
- Enable practical emotional skills for everyday life and work
These services are designed for personal development not medical or psychological treatment.
2. Eligibility
- Users must provide accurate personal and contact information.
- For users under 18 years of age, access to services is permitted only upon receipt of verifiable consent from a parent or legal guardian, as required under applicable law.
- The company reserves full rights to approve, decline, or discontinue any enrollment.
3. Use of Services
- All programs, content, and materials are for personal use only.
- Users may not copy, duplicate, distribute, publish, resell, or share any company materials without written approval.
- Any misuse, inappropriate behaviour, or policy violation may result in immediate termination of access.
4. Fees, Payments & Refunds
- All program fees must be paid in full prior to accessing services.
- Fees are strictly non-refundable except in:
- Duplicate payment
- Program cancellation by the company
- Any other refund required under applicable laws
- Digital materials, assessments, and online modules are non-refundable and non-exchangeable.
- Price revisions may occur and will be communicated when applicable.
5. Scheduling & Attendance
- Users must attend all sessions on time as per the schedule provided.
- Absences must be informed in advance.
- Missed sessions are typically not compensated, unless specially approved by management.
- Recording of sessions is strictly prohibited.
6. Confidentiality & Data Privacy
We maintain strict confidentiality of user information. We may collect:
- Personal details (name, phone, email, DOB, address)
- Session details & assessment results
- Technical data (device, usage, IP address)
We use this information for service delivery, quality improvement, and internal records. We never sell user data.
Information may only be shared:
- With user consent
- If required by law
- To prevent immediate harm
Users must also not share or record any confidential session content.
All personal data is collected and processed in accordance with the Company's Privacy Policy, which forms an integral part of these Terms & Conditions.
7. Code of Conduct
Users must:
- Maintain respectful behaviour toward trainers, staff, and participants
- Avoid harassment, abusive language, or discriminatory behaviour
- Follow trainer guidance and session rules
- Not disrupt sessions or misuse platforms
Violation may lead to suspension or termination. Refunds, if any, shall be governed strictly by Clause 4 of these Terms and applicable law.
8. No Guarantee of Results
Our programs support personal and emotional development, but we do not guarantee:
- Life transformation
- Academic or career success
- Emotional or behavioural changes
- Psychological outcomes
Progress depends entirely on the user's participation, honesty, and personal effort.
9. Intellectual Property Rights
All materials - videos, worksheets, assessments, curriculum, branding, and content - are the exclusive property of the company. Unauthorized copying, distribution, modification, or resale is strictly prohibited and may result in legal action.
10. Limitation of Liability
To the maximum extent permitted under applicable law, The company is not responsible for:
- Personal, academic, emotional, or financial decisions made by the user
- Emotional distress or behavioural outcomes
- Loss of income, opportunities, or academic performance
- Conflicts arising in personal or professional life
Users engage voluntarily and at their own discretion.
11. Termination of Services
The company may suspend or terminate access if:
- Policies are violated
- Misconduct occurs
- Payments are incomplete
- Confidential content is misused
- Sessions are disrupted
Upon termination, all access to materials and programs will be revoked. Refunds, if any, shall be governed by Clause 4 of these Terms and applicable law.
12. Amendments
We may update these terms at any time. Updated policies will be published on the Company's official platforms, and continued use of services after such publication shall constitute acceptance of the revised policy, to the extent permitted by applicable law.
12. Severability
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court or competent authority, such provision shall be severed, and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
14. Governing Law & Jurisdiction
These Terms & Conditions, together with all policies, services, and agreements entered into between the user and the Company, shall be governed by and construed in accordance with the laws of India.
Subject to applicable law, the courts having jurisdiction at Vaishali, Uttar Pradesh, India, where the registered office of the Company is situated, shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms & Conditions and the services provided.
Nothing in this clause shall restrict or affect a consumer's statutory right to approach the appropriate Consumer Commission or other competent authority under the Consumer Protection Act, 2019.
2. Refund & Cancellation Policy
1. General Policy
All fees paid for programs, sessions, workshops, and digital products are non - refundable. Registration implies acceptance of this policy, subject to the exceptions expressly stated herein and applicable law.
2. User - Initiated Cancellation
- Users must send cancellation requests in writing. in writing via email or the designated support channel.
- Cancellations will take effect from the date the written request is received.
- No refunds will be issued for voluntary withdrawal, early discontinuation, or unused sessions.
- Missed sessions will not be refunded.
3. Session Rescheduling
- Rescheduling requests must be submitted at least 24 hours prior to the scheduled session.
- Requests made within 24 hours of the session time will be treated as a no-show.
- Last-minute cancellations or no-shows will not be reconsidered.
4. Company-Initiated Cancellation
If the Company cancels a session or program for reasons not attributable to the user, the Company may, at its discretion, offer either:
- a full refund, or
- the option to shift to another program of equal value.
Temporary delays, rescheduling, or changes in schedule shall not qualify as cancellation and shall not entitle the user to a refund.
5. Digital Content
Payments for:
- Assessments
- Digital courses
- Study materials
- Online modules
are strictly non-refundable, as access is provided immediately after purchase.
6. Refund Exceptions
Refunds may be considered only for:
- Duplicate payments
- Genuine billing-related technical errors
Such refunds shall be processed after verification and at the discretion of management, exercised reasonably and in accordance with applicable law.
7. Misconduct or Policy Violation
If a user is removed from a program due to misconduct, breach of policies, or violation of these Terms, no refund shall be payable, unless otherwise required under applicable law.
8. Policy Modifications
The refund policy may be updated at any time and will be posted on official platforms. The Company reserves the right to update or modify this Refund Policy from time to time.
Any such changes shall apply prospectively and shall not affect payments or services already availed prior to the effective date of such modification.
Updated policies will be published on the Company's official platforms, and continued use of services after such publication shall constitute acceptance of the revised policy, to the extent permitted by applicable law.
